June 12, 2015 Attention: Wendy Guadalawitz The Cupertino Education Association is issuing an immediate cease and desists on the actions taken by the Cupertino Union School District as it relates to the bargaining unit members at West Valley Elementary School. These actions are in direct violation of the CUSD/CEA collective bargaining agreement (CBA). CEA asserts that the CBA does allow for administrative transfers and reassignments as defined in Article 6: Transfers, Sections 6.3.5 and 6.5. However, the process that is already defined in the CBA needs to be followed. Furthermore, the CBA does not allow for the Superintendent or any district administrator to develop their own process of transfer and reassignments without it being collectively bargained with the Association.
